At Perspective Famille, protecting your personal information and privacy is our priority. This policy explains how we collect, use, protect, and share your information in accordance with Quebec's Law 25*. *What is Law 25?

Law 25 is a Quebec law that modernizes the legal framework for personal data protection. Officially named the Act to modernize legislative provisions respecting the protection of personal information, it was adopted in September 2021 and amends existing laws, such as the Act respecting the protection of personal information in the private sector and the Act respecting access to documents held by public bodies and the protection of personal information.

The main objectives of Law 25:

  1. Enhance transparency and accountability: Organizations must be more transparent about the collection, use, and disclosure of personal information. They must designate a person responsible for data protection and make their contact information public.
  2. Obtain explicit consent: The law strengthens requirements for consent, ensuring it is informed, freely given, and explicit.
  3. New rights for individuals: Law 25 introduces rights such as data portability (the ability to transfer data from one organization to another) and the right to erasure (the right to be forgotten).
  4. Obligations for businesses:
    • Businesses must implement security mechanisms and rigorous internal policies to protect personal data.
    • In case of a data breach (such as hacking), they must notify the individuals concerned and the Commission d'accès à l'information (CAI) of Quebec.

This Policy outlines Perspective Famille's practices regarding the collection, use, disclosure, and retention of your personal information.

Our Policy applies regardless of how we collect personal information—whether in person, by phone, by email, or via our website. However, in some situations, we may provide additional information at the time of collection, including a separate consent form for the concerned individual.

It also applies to all relationships between people: board members, donors, staff, volunteers, service users, partners, and anyone working or present in Perspective Famille’s facilities.

Objectives

Respecting privacy and protecting personal information are essential to us. This Policy aims to protect this information in accordance with applicable laws.

To ensure this protection, Perspective Famille commits to collecting, processing, and sharing personally identifiable information only with the individual’s consent, unless permitted or required by law, in which case your consent is not necessary.

The purpose of the Policy is to inform users of the reasons and ways Perspective Famille, or any person acting on its behalf, collects and uses their personal information. It is written in plain language to ensure informed consent from users.

Applicable Law

Perspective Famille is subject to the provisions of the Act respecting the protection of personal information in the private sector (CQLR, c. P-39.1) when such information is held as part of its duties and activities.

Mission and Services

Our mission is to support families going through transitions, single parenthood, blended family situations, or separation by normalizing their context through preventive means, individualized services, and group workshops to minimize the impact of separation on families, particularly in the interest of the children.

We offer, among other things, supervised access rights services, co-parenting support services, youth and parent services, including group workshops, individual support, and a day camp for children.

To fulfill its mission, Perspective Famille offers various services:

  • Co-parenting support service: supervised written communications
  • Youth services ages 4 to 17: individual support, group workshops for youth, specialized self-esteem day camp
  • Parent services: individual support, group workshops
  • Occasional family events

The personal information collected is in accordance with the purposes and objectives set out in this Policy. The personal information collected, and its sensitivity, may vary depending on the context of the interactions between you and Perspective Famille. We collect several types of personal information:

1. As part of our mission and the services we offer

We process, use, share, and retain the personal information of individuals using our services. These records help Perspective Famille carry out its mandate according to the user's requested service. The information is used to create reports and for communications essential to our mission and services. We also process your information to fulfill our legal obligations, including court orders when necessary.

2. Human resources management

We process, use, share, and retain the personal information of directors, members, employees, and candidates to manage employee files, evaluate pre-employment applications, and handle payroll. The personal information collected is listed in the table above.

3. As part of our fundraising campaigns

We process, use, and retain the personal information of donors to collect donations for charitable purposes. This information may include business identifiers. The collected data is listed in the table above.

4. Minors under the age of 14

We process, use, share, and retain the personal information of minors under 14 who use our services. These records help us fulfill our mandate in accordance with the needs identified by a parent/legal guardian or court order. The information is used for report creation and other communications relevant to our mission. We also process this information to fulfill our legal obligations, including court orders if necessary.

Collection Methods

We collect your information through forms, phone calls, emails, or via our platforms. We only use lawful means and rely on your explicit or implicit consent.

Perspective Famille may also collect personal information from third parties in various forms regarding the individual concerned, as part of our mission and the services we offer. This includes, but is not limited to, personal information contained in court records, obtained from the other parent or the child, from a caseworker, lawyer, or external reports.

Rights and Access

Within Perspective Famille, employees will have access to your personal information—either fully or partially—only when necessary to fulfill the purposes disclosed in this Policy.

The law grants you several rights concerning your personal information. However, due to the nature of our mission, please understand that we may not be able to accommodate all requests, especially due to legal obligations.

  1. Access to your personal information
    You may ask us whether we hold personal information about you and, if so, request access in accordance with Perspective Famille’s established procedures.
  2. Correction
    You may request correction of any incomplete or inaccurate personal information we hold about you. However, this right does not apply to the content of our reports.
  3. Withdrawal of consent
    You may withdraw your consent to the communication or use of your personal information. However, doing so may result in being unable to benefit from our services. This may also have legal or judicial consequences. We may also need to disclose, among others and without limitation, to caseworkers and other parties involved in your file that you have withdrawn your consent.
  4. Exercising your rights
    To exercise any of the above rights, please contact our Privacy Officer using the information provided above.

Disclosure to Third Parties

Your information is disclosed to third parties only with your consent or if required by law. Confidential information may be disclosed without consent if the person’s life, health, or safety is seriously threatened. Such disclosure must be made in the least harmful way possible for the individual.

As permitted by law, Perspective Famille may disclose confidential information necessary for its defense or that of its employees against any claims or lawsuits filed against Perspective Famille, its employees, or board members by or on behalf of a service user, employee, heir, estate executor, assignee, or transferee, including claims from an insurer.

Data Retention

We retain your data for defined periods based on its nature and use appropriate security measures to protect it.

Your personal information is also stored virtually on various servers and platforms, including Perspective Famille’s internal server and the servers of the cloud service providers we use. As part of these third-party services, your personal information may be transferred and hosted outside Quebec, including elsewhere in Canada and the United States.

When we determine that transferring your personal information outside Quebec is necessary to support our operations, we assess whether it will benefit from adequate protection. We will only transfer your information if we believe adequate safeguards are in place. Such transfers are also governed by appropriate contractual agreements.

Personal information may also be stored outside the country in which you reside, if a third-party provider or another entity to whom we disclose personal information under this Policy is located outside your country. In such cases, the data may be subject to the local laws of those countries or territories, and local government or law enforcement authorities may have access to it.

Once the retention period has expired, personal information is destroyed. Only statistics or reports containing depersonalized and anonymized data may be retained for extended periods.

Protection Measures

We implement physical, technical, and administrative measures to ensure the security of your information. However, due to the inherent risks of using digital systems, we cannot guarantee the absolute security or confidentiality of personal information you transmit to us. You do so at your own risk.

Filing a Complaint

For any complaint regarding the handling of your personal information, contact our Privacy Officer.

You may also file a complaint with the Commission d’accès à l’information of Quebec by using the form available on the Commission’s website. However, we encourage you to first contact our Privacy Officer.

We may, at our sole discretion, make changes to this Policy from time to time. We always indicate the date the latest changes were made on our website. If the changes are significant, we post a prominent notice on our website. The effective date of the changes is the date of the posted notice.
